These Terms of Service apply when you visit husandhome.co.uk, contact us through the website, create an account or place an order. The website and the products and services offered through it are operated by Hus & Home Ltd (“Hus & Home”, “we”, “us” or “our”). By using the website, you agree to these terms together with our Privacy Policy, Refund Policy and Shipping Policy.

1. Website use and accounts

You may use this website only for lawful purposes. If you create an account, you are responsible for keeping your login details secure and for ensuring that the information you provide is accurate and current. You must not misuse the website, attempt unauthorised access, introduce malicious code, scrape content without permission, interfere with the website’s operation or infringe the rights of Hus & Home or any third party.

2. Product information

We take reasonable care to describe and photograph each product accurately. Many items are original vintage, antique or pre-owned pieces and may show age-related wear, variations, marks or other individual characteristics. These form part of an item’s condition and character where described or visible in the listing. Colours and appearance may vary slightly between screens. Please review the full listing, photographs, measurements and condition information before ordering, and contact us if you require clarification.

Our stock commonly consists of individual pieces. Products and availability may change without notice, and placing an item in your basket does not reserve it.

3. Orders and contract formation

Submitting an order is an offer to purchase. A binding contract is formed when we accept your order and send confirmation of acceptance. We may refuse or cancel an order where an item is unavailable, information or pricing is incorrect, payment cannot be authorised, delivery is not reasonably possible, or we reasonably suspect fraud or misuse. If we cancel an order after payment, we will refund the amount paid.

Please check your order and delivery details carefully. Any cancellation or return rights are set out in our Refund Policy and do not affect your statutory rights.

4. Prices and payment

Prices are shown in pounds sterling and include applicable UK VAT where required unless stated otherwise. Delivery charges and any other applicable costs are shown before checkout. You must provide accurate billing and payment information and be authorised to use the chosen payment method. Promotions may be subject to separate conditions and may be changed or withdrawn where permitted by law.

5. Delivery and collection

Delivery dates and times are estimates unless we expressly agree otherwise. We will take reasonable care in arranging delivery and will contact you if a material delay occurs. Risk in goods purchased by a consumer passes to you when the goods come into your physical possession, or into the possession of a person you nominate to receive them. You are responsible for checking access, dimensions, stairways, doorways and the suitability of the delivery location before ordering large furniture. Additional charges may apply where delivery cannot be completed because access information supplied was incomplete or inaccurate, provided those charges are reasonable and explained to you.

6. Returns, refunds and consumer rights

Returns, cancellations and refunds are governed by our Refund Policy. Nothing in these terms excludes or restricts rights you have under applicable consumer law, including rights relating to goods that are faulty, not as described or not of satisfactory quality.

7. Services and bespoke arrangements

Where we agree sourcing, hire, design, installation or other services, additional written terms, quotations, deposits, timescales or cancellation provisions may apply. If there is a conflict, the specific written terms agreed for that service will take priority.

8. Intellectual property

The website’s design, branding, text, photographs, graphics and other content are owned by or licensed to Hus & Home Ltd and are protected by intellectual property law. You may view and use the website for personal, non-commercial purposes. You may not copy, reproduce, publish, distribute, modify or commercially exploit our content without prior written permission.

9. Third-party services and Shopify

The website may contain links to or use services supplied by third parties. Their own terms and privacy policies may apply. The store is hosted by Shopify, which provides the ecommerce platform, but purchases made from this store are contracts directly between you and Hus & Home Ltd.

10. Privacy

We process personal information in accordance with our Privacy Policy. Shopify and payment, delivery or other service providers may process information where necessary to operate the website and fulfil orders.

11. Liability

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights. Subject to those protections, we are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses suffered by a consumer. If you use the website or purchase goods wholly or mainly for business purposes, our liability is limited to the amount paid for the relevant goods or services, except where liability cannot lawfully be limited.

We may update these terms from time to time. The version published on this page applies from its stated publication date. We may change, suspend or withdraw website features, but this will not affect contracts already accepted except where required by law or agreed with you.

These terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you retain any mandatory protections provided by the law of your part of the UK and may bring proceedings in the courts available to you under applicable law.
